The immigration implications of company restructuring, reorganisation or redundancy are complex as the requirements of employment law and immigration law can differ.

A change in ownership of a business can lead to the loss of your sponsor licence, but your sponsored staff will not automatically transfer over to a new employer’s sponsor licence (even if a TUPE transfer occurs). And being level 1 users on many clients’ sponsor licences, we can often report for you and produce the necessary supporting documentation for the Home Office. Mistakes can lead to the loss of a sponsor licence and staff members’ only being allowed to remain in the UK for 60 days.
