Higher Fees for Certain Employment Tribunal Claims

Certain employment tribunal claims which are currently Type A claims are to be reclassified as Type B claims, meaning that they will attract a higher fee.

The changes, which affect claims issued on or after 6 April 2014, apply to claims including:

  • equal pay claims; 
  • claims that an employer failed to inform or consult under the Transfer of Undertakings (Protection of Employment) Regulations 2006; and 
  • claims that an employer refused to allow compensation, payment or compensatory rest under the Working Time Regulations 1998.

The changes are designed to correct errors made when fees were introduced last July. 

The changes are made by the Courts and Tribunals Fees (Miscellaneous Amendments) Order 2014.
