The immigration implications of company restructuring, reorganisation or redundancy are complex as the requirements of employment law and immigration law can differ.

A change in ownership of a business can lead to the loss of your sponsor licence, but your sponsored staff will not automatically transfer over to a new employer’s sponsor licence (even if a TUPE transfer occurs). Fortunately, we have lawyers in our team who practice employment and business immigration, and so can support you with both.

We have a wealth of experience in advising companies of their obligations, and of key deadlines, which you cannot miss in these circumstances. We can advise on the impact of mergers, takeovers, TUPE transfers and similar changes on a sponsorship licence. 

And being level 1 users on many clients’ sponsor licences, we can often report for you and produce the necessary supporting documentation for the Home Office. Mistakes can lead to the loss of a sponsor licence and staff members’ only being allowed to remain in the UK for 60 days.
