The Government has published draft legislation confirming that the increase in the unfair dismissal qualifying period will only affect those whose employment begins on or after 6 April this year.
The Government confirmed late last year that from 6 April 2012 it would be increasing the qualifying period of service needed to bring an unfair dismissal claim to two years. However, it gave no indication of how this might affect existing employees.
Although it was always unlikely that those who had already accrued unfair dismissal rights at that date would be affected by the change, the position was less clear in relation to those who would not achieve a year's service by that date.
The draft Regulations also increase the qualifying period that applies to the right to receive a written statement of reasons for dismissal, on request. The current one-year qualifying period will increase to two for any employee who starts work with their employer on or after 6 April 2012.
